OPM Disability Denial: Accommodation Impossible Not Proven
Why OPM Denied You on Accommodation Grounds
One of the five statutory requirements for FERS disability retirement under 5 CFR § 844.103 is proof that the employing agency could not accommodate your medical condition or reassign you to a vacant position at the same grade or pay within your commuting area. When OPM's denial letter cites this element, it usually means one of two things: the agency's SF-3112D certification was incomplete, or the agency never submitted it at all.
This is an infuriating denial reason for applicants because it's almost entirely outside your control. You didn't write the SF-3112D — your agency's HR office did. But OPM holds you responsible for the evidentiary completeness of your application, even for the parts your agency was supposed to prepare.
What the SF-3112D Should Contain
Form SF-3112D is the Agency Certification of Reassignment and Accommodation Efforts. When properly completed, it documents:
- Whether the agency attempted reasonable accommodation for your condition
- What accommodations were considered and why each was rejected as ineffective
- Whether the agency searched for vacant positions at the same grade or pay level within the commuting area
- The results of that search — either no positions existed, or none matched your residual functional capacity
- A certification from the agency's disability program manager or HR specialist that accommodation and reassignment were genuinely explored
OPM denies on this ground when any of these elements is missing or vague. Common problems:
- The agency checked a box saying "accommodation not possible" without explaining what was considered
- The vacancy search was never documented
- The supervisor wrote the certification instead of the designated HR official
- The form was left blank and submitted anyway
How to Fix This in Your Reconsideration
You have 30 calendar days from the denial to file your reconsideration request under 5 CFR 841.306. Here's how to address the accommodation gap:
1. Request your complete OPM claim file. Write to OPM at the Boyers, PA office and request a copy of everything in your file, including the SF-3112D your agency submitted. You need to see exactly what the agency wrote — or didn't write — before you can fix it.
2. Go back to your agency HR office. Even if you've been separated, ask the agency for a supplemental SF-3112D or a separate memorandum from the disability program manager addressing the specific deficiency OPM identified. Put this request in writing and keep a copy.
If your agency is unresponsive — a common problem, especially after separation — document your attempts. Send your request via email and certified mail. Note the dates and the lack of response. Include this documentation in your reconsideration package to show OPM that you made reasonable efforts.
3. Build the accommodation record yourself. If the agency won't cooperate, submit available records showing what accommodation and reassignment steps were considered, and document your efforts to obtain the agency certification OPM requires. Gather:
- Emails between you and your supervisor or HR about accommodation requests
- Any formal accommodation request you filed under the agency's reasonable accommodation process
- Denial letters from the agency's accommodation committee
- Your position description, highlighting essential functions that your condition prevents
- Your physician's statement about functional limitations that make accommodation infeasible

The Reassignment Search Problem
OPM also requires evidence that the agency looked for vacant positions you could fill. Many agencies skip this step entirely or perform a cursory search. If the SF-3112D doesn't document a reassignment search, OPM treats the element as unproven.
For your reconsideration, you can submit evidence showing why reassignment was impractical:
- If your condition prevents you from performing any position at your grade level, your physician should state this explicitly
- If your agency is small or geographically isolated, document the limited number of positions available
- If you work in a specialized occupation series with no comparable positions in the commuting area, show this through vacancy listings or organizational charts
The legal standard isn't that the agency prove no vacancy existed anywhere in the federal government — only within the commuting area at the same grade or pay.
When Agency Removal Strengthens Your Case
If your agency separated you specifically for medical inability to perform useful and efficient service, that action may trigger the Bruner presumption. Under Bruner v. OPM, 996 F.2d 290 (Fed. Cir. 1993), it creates a prima facie case for disability retirement and shifts the burden of production to OPM; it does not by itself establish that accommodation and reassignment were impossible.
Check your SF-50. If the nature of action reflects medical inability removal, cite this in your reconsideration brief as support for the Bruner presumption and address the accommodation and reassignment evidence separately.
