FERS Disability Retirement One Year Filing Deadline: What Counts and What Happens If You Miss It

The Deadline That Ends Your Eligibility

Under 5 U.S.C. § 8453, a FERS disability claim must be filed with OPM before separation or within one year afterward. OPM may waive the time limit only if you were mentally incompetent at separation or became incompetent within the following year; you must then apply within one year after restoration to competency or appointment of a guardian, whichever comes first. A former employee applies directly through OPM's Online Retirement Application (ORA), and OPM must receive the application by the deadline.

For federal employees with psychiatric conditions — particularly depression that impairs executive function and motivation — this deadline creates a cruel paradox. The very condition that qualifies you for disability retirement also makes it extraordinarily difficult to assemble and submit a complex application package within a fixed timeframe.

How the Filing Routes Work

Your filing route depends on how long it's been since you left the agency:

Currently employed: Contact your agency's Human Resources office to start the disability application through ORA. HR may help complete the forms and forward the package to OPM. The one-year clock does not start until your separation date.

Separated from service: Submit directly to OPM through ORA. Ask your former supervisor and agency to complete SF 3112B, SF 3112D, and SF 3112E, then upload those documents to your application. You are responsible for providing the required medical evidence and proof of your SSDI application.

The practical difference is significant. Current employees start through agency HR. Former employees submit through ORA themselves but still need their former supervisor and agency to complete the required forms.

What "Received by OPM" Means

The deadline is measured by when OPM receives your application. If you're filing close to the one-year mark:

  • Submit through ORA and keep the submission confirmation showing the date OPM received your application.
  • Do not rely on a postal postmark or fax confirmation as proof of an ORA filing date.

If the deadline is approaching while agency documents are delayed, do not wait for them. OPM's instructions say an incomplete application is timely if OPM or your former agency receives it by the deadline; include the names and contact details of the people completing the remaining forms, then submit the missing documents when ready.

When the Clock Starts

The one-year period begins on your effective date of separation — the date on your SF-50 (Notification of Personnel Action) showing your separation from federal service. This is not necessarily your last day of work. If you were on LWOP before separation, your last day of work and your separation date may differ.

Situations that affect the clock:

  • Voluntary resignation: the effective date on your resignation SF-50 starts the clock.
  • Removal for medical inability or performance: the effective date of the removal action starts the clock.
  • Retirement under a different provision: if you retired under regular FERS but should have filed under disability, the clock still runs from your separation date — but you may be able to convert to disability retirement if the condition existed at separation.
  • Involuntary separation during a RIF: same rule. Your separation date on the SF-50 is day zero.

What Happens If You Miss It

The statute provides a narrow waiver for mental incompetence. OPM may waive the one-year limit if you were mentally incompetent when you separated or became incompetent within one year afterward, and you apply within one year after you are restored to competency or a guardian is appointed, whichever comes first.

Outside that statutory waiver, a late application generally misses the filing deadline. If your condition may have affected your ability to apply, get advice promptly about whether the waiver applies.

The Role of Family Members and Proxies

This is where the deadline intersects with the reality of severe psychiatric disability. Many applicants with major depression, PTSD, or bipolar disorder are cognitively impaired to the point where assembling a multi-form application package is functionally impossible during acute episodes.

There is no formal "power of attorney" requirement for FERS disability retirement filing, but a family member or designated representative can:

  • Help gather and organize the application forms
  • Coordinate with the applicant's former supervisor and agency to obtain SF 3112B, SF 3112D, and SF 3112E
  • Help the applicant's psychiatrist understand what OPM requires on the SF 3112C
  • Help the applicant submit through ORA by the deadline and upload supporting documents as they are completed

If you're a spouse, parent, or adult child of a federal employee who separated due to a psychiatric condition, understanding this deadline is essential. The employee may not be tracking time, may not be opening mail, and may not grasp that their eligibility has an expiration date. Starting the process at month 8 or 9 leaves very little margin for the inevitable complications — a provider who takes three weeks to complete the SF 3112C, a former agency HR office that doesn't respond to requests for SF 3112B completion, a missing personnel file.

Start early. File as soon as the application is ready. The back pay accrues regardless — there's no advantage to waiting.
