Ex-Spouse Died Before Retirement: What Happens to Your Federal Pension Share

When a federal employee dies before retiring, their annuity never begins — which means your court-ordered share of that annuity also never materializes. But that does not necessarily mean you walk away with nothing. Two other benefits may apply, and both require you to act quickly.

Annuity Apportionment Dies With the Employee

If your COAP awards you a percentage of the employee's monthly annuity, that benefit depends on the employee actually retiring and receiving an annuity. An active employee who dies before separation never generates an annuity payment, so there is nothing for OPM to apportion.

This is a painful reality for former spouses who waited years for their ex-spouse to retire, only to have the expected income stream disappear entirely.

Former Spouse Survivor Annuity: The Safety Net

If your court order expressly awarded you a former spouse survivor annuity — and the order was filed with OPM before the employee's death — you may be entitled to monthly survivor annuity payments. This is a separate benefit from the annuity apportionment, and it activates on the employee's death whether or not the employee had retired.

For FERS employees who die in active service with at least 10 years of creditable service, the former spouse survivor annuity equals up to 50% of what the employee's annuity would have been. For CSRS, the maximum is 55%.

The critical requirement: the COAP must have been on file with OPM before the death occurred. A court order submitted after the employee's death cannot establish a new survivor annuity.

FERS Basic Employee Death Benefit (BEDB)

If the deceased active employee completed at least 18 months of creditable civilian service under FERS, a qualifying court order can entitle the former spouse to the Basic Employee Death Benefit. As of 2026, the BEDB equals:

50% of the employee's final salary (or high-three average pay, if higher) + $43,800.53

You can elect to receive this as a single lump sum or in 36 monthly installments calculated using OPM's present value factor. The lump sum is eligible for direct rollover into an IRA, which defers the tax.

Filing Your Claim

You must notify OPM Retirement Services immediately upon learning of the death and submit:

  • Form SF 3114 (Application for Death Benefits — FERS) or Form SF 2800 (CSRS)
  • Certified copy of the death certificate
  • Certified copy of your COAP if OPM does not already have it on file
  • Non-remarriage certification if applicable (remarriage before age 55 terminates survivor benefits)

When No Survivor Annuity Was Awarded

If your divorce decree divided the annuity but did not specifically award a former spouse survivor annuity, you have no claim to survivor benefits. The distinction matters enormously: an annuity apportionment is a share of the living retiree's monthly payment, while a survivor annuity is a separate benefit triggered by death.

Many divorce attorneys fail to include survivor annuity language in federal retirement orders. If your ex-spouse is still alive and your COAP lacks survivor provisions, you may be able to obtain an amended court order that adds a former spouse survivor annuity — but only if the employee has not yet retired, or if the retirement system allows post-retirement amendments.
