SSDI Approval and FERS Disability Appeal: How Social Security Evidence Strengthens Your OPM Case
Getting approved for Social Security Disability Insurance while your FERS disability appeal is pending feels like it should resolve everything — if the SSA concluded you're disabled, how can OPM maintain that you're not? The answer lies in different statutory standards, and understanding the distinction determines how effectively you can use your SSDI award in your OPM reconsideration or MSPB appeal.
Different Standards, Different Outcomes
SSDI requires proving you cannot perform any substantial gainful activity in the national economy. FERS disability retirement requires proving you cannot perform useful and efficient service in your specific federal position. The FERS standard is narrower — it's about your job, not all jobs. An SSA denial doesn't doom your FERS claim, and an SSA approval doesn't guarantee FERS approval.
That said, an SSDI approval is strong evidence. Under Trevan v. Office of Personnel Management, 69 F.3d 520 (Fed. Cir. 1995), an SSA decision awarding SSDI constitutes material evidence that OPM and the MSPB must explicitly consider. If the MSPB affirms OPM's denial after you've been approved for SSDI, the Board must explain why the SSA's finding isn't persuasive. It can't just ignore it.
How to Submit the SSDI Award
If you receive SSDI approval during the appeal process, submit it immediately as supplemental evidence — to OPM if you're in the reconsideration stage, or to the MSPB if you've already filed an appeal. Include the full SSA determination letter, not just the approval notice. The determination letter identifies the medical evidence the SSA reviewed and the basis for its conclusion.
File it as a formal exhibit with a cover letter citing Trevan v. OPM and requesting that the adjudicator give the SSDI award its due weight as material evidence of disability.
The Mandatory SSDI Application Requirement
Under 5 U.S.C. § 8451(f) and 5 CFR 844.104, every FERS disability retirement applicant must apply for SSDI. OPM will not pay a FERS disability annuity until you provide proof that you've applied for SSDI — either an application receipt or an approval/denial letter. If you haven't applied yet, do so immediately, regardless of where your OPM appeal stands.

The FERS-SSDI Offset: What Most People Get Wrong
Here's where confusion is rampant, and getting it wrong has real financial consequences. There are two completely separate concepts:
The WEP and GPO are repealed. The Social Security Fairness Act (H.R. 82, signed January 5, 2025) eliminated the Windfall Elimination Provision and the Government Pension Offset for benefits payable from January 2024 onward. If you or your spouse were previously affected by these provisions, SSA has paid retroactive adjustments. This is fully implemented and settled.
The FERS disability SSDI offset under 5 U.S.C. § 8452 is still active. This is a completely different provision. If you receive both a FERS disability annuity and SSDI, your FERS annuity is reduced — 100% of the SSDI amount is offset in the first year of disability retirement (when FERS pays 60% of your high-3), and 60% of the SSDI amount is offset from the second year until age 62 (when FERS pays 40% of your high-3 minus 60% of SSDI). The WEP/GPO repeal did not touch this offset.
Confusing the two leads to financial miscalculations. Online forums frequently muddle them, and some pre-2025 guidance doesn't distinguish between the federal Social Security offsets (repealed) and the FERS-specific disability offset (active).
Strategic Timing
If your SSDI application is pending while your FERS reconsideration is under review, you may receive the SSDI determination before OPM acts on your reconsideration. Submit the result immediately, either way. An SSDI approval is material evidence for your FERS case. An SSDI denial does not automatically defeat it — the standards differ, and the SSA decision is not binding on OPM.
