FERS Disability Retirement Appeal and Reconsideration After OPM Denial

The Two-Stage Appeal Path

An OPM denial of your FERS disability retirement claim is not the end. Federal law provides two levels of review beyond the initial decision, each with a 30-day filing window.

Stage 1: Reconsideration by OPM — You have 30 calendar days from the date on OPM's denial letter to submit a written request for reconsideration. This is a paper-only process reviewed by a different OPM adjudicator than the one who denied your initial claim.

Stage 2: Appeal to the Merit Systems Protection Board (MSPB) — If OPM upholds the denial on reconsideration, you have 30 calendar days from the reconsideration decision to file an appeal with the MSPB. The MSPB conducts an independent review and can reverse OPM's decision.

Missing either 30-day window forfeits that level of review. After a timely reconsideration request, you may ask OPM for an additional 30 days to gather supporting medical evidence. The MSPB applies only limited exceptions for late appeals.

What Reconsideration Actually Involves

Reconsideration is your strongest opportunity to fix the evidentiary weaknesses that caused the denial. OPM's denial letter identifies the specific reasons for rejection — typically one or more of these:

  • Insufficient medical evidence linking the condition to your position duties
  • No documentation that reasonable accommodation was attempted or denied
  • Missing proof of SSDI filing
  • The medical evidence did not establish that the condition is expected to last at least one year
  • The agency's reassignment search was incomplete or not properly certified

Your reconsideration request should directly address every stated deficiency. This is not a general appeal letter — it is targeted gap-filling. If OPM said your physician's narrative was conclusory, your reconsideration should include a revised, detailed clinical narrative that maps specific symptoms to specific position duties. If OPM said the accommodation record was insufficient, submit additional documentation from your agency's Reasonable Accommodation Coordinator.

You can submit new medical evidence that was not part of the original application. Many successful reconsiderations include updated clinical reports, specialist evaluations, or functional capacity assessments that were not available at the time of initial filing.

Preparing for an MSPB Appeal

If OPM denies you again on reconsideration, the MSPB appeal is a quasi-judicial proceeding with significantly different dynamics. An MSPB Administrative Judge reviews the case independently and can take testimony, admit evidence, and issue a binding decision.

The MSPB standard of review shifts the burden: OPM must justify its denial, and the Board evaluates whether OPM's decision was supported by substantial evidence. This is where legal representation becomes particularly valuable. Common Denial Reasons and How to Address Them

"Conclusory medical evidence." This is the most frequent basis for denial. OPM received a physician's note saying "the employee cannot work" or "the employee is disabled" without a detailed narrative connecting clinical findings to specific job functions. Fix it with a comprehensive physician statement that references your official position description by title and grade, identifies the specific duties you cannot perform, and explains the medical basis for each limitation.

"Accommodation not exhausted." OPM determined that your agency did not formally certify that reasonable accommodation was impossible, or that you did not engage in the interactive process. Obtain a supplemental statement from your agency's HR or accommodation office documenting the accommodations attempted and the reasons they failed.

"Condition is temporary." OPM concluded that your medical condition is expected to resolve within one year. Submit updated medical evidence showing the condition's prognosis, any deterioration since the original filing, and a physician's opinion on the expected duration.

"Reassignment not certified." SF 3112D was missing or incomplete. Contact your former agency's HR office to obtain a properly completed certification of the reassignment search results.

For reconsideration, many applicants successfully handle the process themselves by directly addressing the stated deficiencies with stronger evidence. The reconsideration is a paper process — no hearings, no testimony, no cross-examination.
